Supreme Court announces date for pre-trial hearing of presidential petitions

The Supreme Court has announced the beginning of the presidential petitions pre-trial hearing.

A pretrial conference has been set for Tuesday, August 30, 2022, at 11 a.m. by the Supreme Court.

Within eight days of a presidential election petition’s filing, the Supreme Court must have a pre-trial conference.

It offers a relaxed setting for both parties and the judges to identify the facts that are agreed upon or are in dispute, to make clear the issues between the parties, and to try to reach a voluntary agreement to address them.

Immediately following the pre-trial meeting, the Supreme Court must consider the election dispute petition and provide a ruling within 14 days.

Nine petitions have been submitted to the Supreme Court thus far. The pre-trial hearing is anticipated to include participation from all nine petitioners and their respondents.

Other petitioners include John Njoroge Kamau, Daniel Kariuki Ngari, Juliah Nyokabi Chege, Khelef Khalifa, Okiya Omtatah, Youth Advocacy Africa, and Reuben Kigame in addition to Azimio La Umoja, one Kenya coalition party.

Moses Kuria, the head of the Chama Cha Kazi Party, has also asked the Supreme Court to reject Raila Odinga’s case to invalidate William Ruto’s election victory as the president-elect of the Azimio La Umoja One Kenya Coalition.

In a lawsuit filed against the IEBC, its chairman Wafula Chebukati, commissioners, and William Ruto, Odinga and Karua are pleading with the court to declare the Presidential Election results announced on August 15 null and illegal.

Omtatah also requested the annulment of the presidential election results announced by the IEBC, arguing that none of the candidates had reached the constitutional requirement of 50% plus one.
