Rael Mayaka, an 80-year-old grandmother, was freed from prison by the Court of Appeal after she was accused of gouging out her grandson Baby Sagini’s eyes.
Due to the grandmother’s flimsy case, the court reversed a decision that had sentenced her to five years in prison on Friday, February 2.
The judge declared that the prosecution had not proven its case.
Justice Kiarie further noted the prosecution did not prove the case beyond reasonable doubt and that there was no evidence that the accused committed the offence.
Rael had filed an appeal which she did within 14 days while her counterparts who had been sentenced to 10 years and 5 years respectively did not do so.
