MP Salasya ordered to pay Sh500K debt plus interest, threatens to kill Magistrate

Mumias East MP Peter Kalerwa (PK) Salasya has been ordered by the Kakamega Small Claims Court (SCC) to pay Sh500,000 plus interest that is owed to a businessman.

The MP’s counterclaim for failure to pay the debt was rejected by the court as insufficient, ludicrous, and convincing.

The judge also ordered the legislator to reimburse the businessman Robert Lutta of Kakamega for the expenses he incurred in filing the case, according to the ruling handed down by SCC Adjudicator Gladys Kiama Nashipai yesterday afternoon.

“The counterclaim by the respondent (Salasya) was inconsistent. He first claimed that he had personally loaned the claimant (Lutta) Sh1 million, which he (Lutta) was repaying only to change during the hearing by saying that he loaned the money through a proxy,” reads part of the judgment.

“The proxy in question, one Bernard Kemba, could in turn not even identify the claimant (Lutta) even after an identification parade was carried out in court.”

Nashipai also said even as the businessman had bank transfer proof to back his claim that he loaned Salasya the Sh500,000 that he refused to pay, the latter lacked binding evidence to show that he loaned Lutta the alleged Sh1 million.

Salasya, who was represented by lawyer Webo, asked the court for a 30-day stay on the execution of the judgment, which was granted.

Through lawyer Edwin Wafula, Lutta sued the MP on October 23, alleging that he innocently loaned Salasya the amount in the hope that he would refund it in two months, but has since become elusive.

New reports suggest that Peter Salasya is wanted by the police for allegedly threatening to kill the Kakamega magistrate.

The MP is said to have confronted and threatened Resident Magistrate Gladys Kiama outside the court on Monday.

This was after she ordered him to pay a lawyer Sh500,000 in a small claims case.

According to the police, the MP has switched off his mobile phones and gone into hiding.

They have asked him to surrender and record a statement.

His aides have also claimed that they do not know his whereabouts.

Magistrate Kiama reported the incident to the Kakamega police station on Monday afternoon.

She said the MP had threatened to kill her before he fled.

She had just delivered a judgment in which she dismissed Salasya’s counterclaim against paying the debt.
