Inside Raila Odinga’s Supreme Court Petition Against Ruto’s Win

Azimio flag bearer Raila Odinga, who was declared second in the presidential results, has officially filed a petition at the Supreme Court, demanding the nullification of William Ruto’s win.

Mkenya Leo has accessed the official document of the petition, and has compiled the issues raised by Odinga regarding the credibility of the presidential results.

Here are the issues raised

The incapability of the IEBC to hold a proper election

Raila argues that the current prowess of the IEBC has been interfered with; thus, the body is not capable of holding a free, credible, and fair election. He sites the accusations made by the dissenting four IEBC commissioners. Juliana Cherera, Justus Nyang’aya, Irene Masit, and Franci Wanderi, as part of his reasons.

He also claims that the electoral process did not fully comply with the Constitutional laws; thus, the final results cannot be credible.

“Contamination” of the final results

Raila insists that results have been manipulated, resulting in the illegal win of his opponent. He demands a forensic audit to be conducted to facilitate the genuine tallying of the results. He argues that this is the only way that all votes affected by “irregularities” will be struck off from the system to produce credible results.

Ruto did not attain the winning threshold

According to Raila, Ruto did not attain the 50+1% threshold in the elections due to the “contamination of the final results. He, therefore, maintains that the declaration of Ruto as the president-elect was invalid.

Revocation of Ruto’s IEBC Certificate and the invalidity of Gazette Notice of Ruto’s Win

Raila wants the court to order the IEBC to cancel Ruto’s certificate as the president-elect. He also wants the court to pronounce the Gazette Notice 9773, declaring Ruto the president-elect, invalid.

Removal of Chebukati from the IEBC Leadership
In the petition, Raila accuses IEBC chairman Wafula Chebukati of not being capable of holding public office. Raila sites that Chebukati breached the authority entrusted to his office to render proper, credible, free, and fair elections. He claims that Chebukati has brought “dishonor to the nation” and has “undermined the public confidence bestowed to him by the people of Kenya
