Diana Ndung’u: How I lost Sh24 million home for a loan I never borrowed

A Nairobi businesswoman yesterday narrated how she lost her Sh24million home to auctioneers for failure to settle a bank loan, which she never borrowed.

In her testimony before the Milimani Senior Resident Magistrate Geoffrey Onsarigo, Diana Waithira Ndung’u narrated how she lost her matrimonial home for failure to settle a Sh11.25 million loan she knew nothing about.

Waithira who is homeless painfully asked the court to help her recover the home she had lived in since 2009.

The court heard that Waithira’s ordeal started in September 2018 when she was accosted by strangers who handed a letter from Adept Realtors Limited informing her that they wanted to value the home.

“I was handed a let- ter which indicated that they intended to do a valuation of my house,” said Waithira.

A few days later, Waithira received another letter from Nairobi Auctioneers giving her 45 days to vacate the house since it was to be auctioned, the court heard.

From the letter, she learnt that a company by the name Thai Group Kenya Limited had failed to settle a loan of Sh11.25 million borrowed from Sidian Bank using her home as collateral.

She confronted her husband with the letter, but he denied borrowing any money from the bank, the court was told.

Waithira said that she confronted the bank over the matter, only to be told that Thai Group Kenya Limited had secured a Sh11.25 million loan using her home as collateral but defaulted in repayment.

“They produced execution form dated February 3, 2018 with my name and a signature purported to be mine and a copy of title deed of the plot where my house sits.”
