This morning, after becoming ill, former TV anchor Jaque Maribe requested that the court postpone the delivery of her ruling in Monica Kimani’s murder case.
The court was to pronounce its judgement this morning at 9 am. But only his former lover Jowie Irungu was present in court.
Maribe’s advocate Katwa Kigen urged Trial Judge Grace Nzioka to accommodate her as she is seriously ill. Katwa said the nature of her ailment is confidential but the state prosecutor Gakoe Gichuhi said the medical documents should be made available to them.
She did not object to the adjournment saying sickness is not something that can be controlled. Maribe said she expects to be well recovered within the next seven days.
She also stated she is willing to go to Naivasha where the trial Judge usually sits for delivery of the judgement.
“She is greatly indisposed. She was not able to come to court. She had intended to be here,” said Katwa.
However, Trial Judge Nzioka slated the matter for March 15 and declined Maribe’s request to have the judgment delivered in Naivasha where the Judge usually sits owing to resource constraints.
“There’s no provision for virtual today and if you tell me you’re unwell, I don’t know where you are. The integrity of the court proceedings must be observed. I would rather have an open court appearance,” she explained.
“When do we deliver this judgment? I have looked at my diary. The court is not available for the whole of January and February.”
“I have taken time off the course from February 8 to March 8, 2024, to write judgments. I am willing to say that all parties are to be available for March 15, 2024. I will need adequate time to deliver this judgment,” she added.
