Here’s What to Expect After Chebukati Announces The Presidential Results

If “tumbojoto” was a person, is us Kenyans.

The counting and verification are finally done. We are anxiously waiting for the IEBC chairman Wafula Chebukati to announce the winner anytime from now.

However, do you know what will happen after the winner is announced?

Here is an explanation of the possible outcomes after the president-elect is announced.

A Clear Winner

In this case, a clear winner, or undisputed winner is the one who will scoop 50+1% of the total votes per the elections laws introduced in the 2010 constitution. This number translates to winning a quarter of the votes in 24 counties out of the 47 counties.

The clear winner is sworn into office after seven days.

A Run-Off

This will only happen if neither of the presidential candidates managed to get the above criteria. Here, the two leading candidates will go into a run0off to determine a clear winner. The law requires the IEBC to plan the run-election in 30 days.

From the results we have seen, Raila Odinga and William Ruto are the leading candidates. Thus, they would be the candidates if a run-off were to happen.

Court Petition

This outcome means we already have a clear winner, but his win has been disputed. The disputer mostly rejects the results over claims of elections rigging. He/he must present the case to the Supreme Court, the highest court in Kenya, in seven days.

If his case is upheld and the court determines his allegations are true, the law requires IEBC to organize another presidential election in 60 days.
