Katiba Institute moves to Court to stop the appointment of 34 Judges
Katiba Institute files an application at the High Court, challenging the appointment of 34 Judges and leaving 6 nominees by President Uhuru Kenyatta. The institute says the swearing-in of the 34 will violate the constitution as well as the rights of the remaining six.
Through its Lawyer Dudley Ochiel, Katiba Institute argue that the cherry-picking by President Uhuru Kenyatta is illegal.
“The cherry-picking and selective appointment or swearing-in of judges undermines the functions and powers of the Judicial Service Commission and the functioning of the Judiciary. It also is an improper extension of the role of the Executive and has created a constitutional crisis,” Ochiel argues.
The Lobby group further argues that the partial swearing-in of a few judges would irreparably violate the Constitution.
