Warrant of arrest issued against Senator Allan Chesang
A Nairobi court has issued a warrant of arrest against Trans Nzoia Senator Allan Kiprotich Chesang, who is accused of fraud and forgery over Ksh14 Million fake tender for the supply of gunny bags at the Ministry of Defence.
Milimani Senior Resident Magistrate Caroline Muthoni issued the warrant against Senator Chesang after he skipped court proceedings on Friday, November 11, 2022.
While issuing the arrest order, the court noted that Chesang had developed a tendency of not appearing in court for the trial of his case.
In the case, the senator is charged alongside eight other persons for defrauding a Managing Director of WIL Developers and Construction Limited Johnson Mwanzia Wambua Ksh14 million on the pretence that he had won a tender with the Ministry of Defence.
The accused persons are alleged to have forged documents and lied to Mwanzia that he had won the multi-million award tender for the supply of 50 kilogrammes Jute bags at the Department of Defence.
The Director of Public Prosecution(DPP) alleges that Chesang together with his accomplices forged several documents including the contract documents for the tender and the signatures of former Defence Principal Secretary Torome Saitoti and Rotich K. of the Finance Department in the Department of Defence.
Chesang and his co-accused persons namely Clifford Okoth Ongugo alias Victor Wandera, Samuel Muremet Masaai, Dedan Waithaka Mwangi, David Kahi Ambuku, Elysha Onyango Oswago, Cliff Moseti Obwogi, Esther Karungo Ngotho and Boniface Kamau Macharia have since denied the several charges of making a false document, obtaining money by false pretences, forgery and presenting the false documents.
According to the charge sheet, the nine accused persons are accused that:” On diverse dates and places within the Republic of Kenya, with intent to deceive, jointly with others at large, without lawful authority or excuse made a certain document namely Contract Document Reference No. MODP/SUPPlS/0451-270/2017-18/SP dated January 2018 purporting it to be a genuine and valid Contract Document for the supply of goods between the State Department for Defence and WIL Developers and Construction Limited.”
In the second count, Chasang and his co-accused are further charged that with intent to defraud they forged the said tender documents purporting it to be genuine and valid signed by Saitoti and Rotich.
The suspects are also accused of making a fake notification of award for the multi-million tender for the supply of 50 Kilogrammes Jute bags claiming to be genuine issued by the Department for Defence to the Managing Director, WIL Developers and Construction Limited.
They are further charged that on February 1, 2018, at Standard Bank of Kenya Ltd Harambee Avenue Branch in Nairobi county, jointly with others still at large with intent to defraud obtained from Johnson Mwanzia Wambua Ksh 6,5 million and a further Ksh 7.5 million by falsely pretending that they had acquired a tender to supply gunny bags to the Department of Defence.
The nine have also denied forging another notification of award letter for the same tender purporting it to be genuine and valid signed by the Chief Procurement officer in the department of Defence Kibichu. M.
They also face a charge of presenting the forged tender award documents to Mwanzia on January 22, 2018, at Panafric Hotel in Nairobi county.
