The Independent Electoral and Boundaries Commission (IEBC) has been ordered by the Supreme Court to file Form 32As and Form 34As for 41 stations as instructed by the court.
In an order on scrutiny and recount issued on Tuesday, August 30, 2022, the court’s registrar informed the supreme court that numerous interested parties had been unable to come to an agreement on how to conduct the exercise.
“Otieno Ogola & Company Advocates writes and says he wants Form 32 A from all 229 stations, Njoki Mboshe and Company write and says they want for 238 stations. The petitioners have asked for 517 stations. Obviously, for the time we have, it is impossible to comply with that order.
“We order that the IEBC provide Form 32 and Form 34 A Book 2 from the 41 stations in the application of celestine Anyango Apiyo. That is the only way that exercise can have meaning,” Justice Lenaola ruled.
Given the short deadlines set for the review, he added that moving beyond the predetermined stations would constitute a new case.
