The panel of Justice Aggrey Muchelule has advised that Irene Masit, an IEBC commissioner who is currently on suspension, be fired.
Muchelule claimed in a report that the IEBC commissioner’s charges were validated.
“Therefore, this tribunal recommends to Your Excellency, the President of the Republic of Kenya, pursuant to the mandate assigned vide Gazette Notice No. 14790 of December 2, 2022, and further in accordance and in compliance with Article 251 (1) and (6) that Commissioner Irene Cherop Masit be removed from office as a member of the Independent Electoral and Boundaries Commission,” the reports read in part.
The tribunal said the evidence presented proved that Masit had violated the Constitution and had gross misconduct during the 2022 general elections.
The tribunal began its hearing on Masit on December 20.
She is among the four IEBC commissioners suspended from office by President William Ruto on December 2, 2022.
The others included former Vice-chair Juliana Cherera, and former commissioners Justus Nyang’anya and Francis Wanderi.
The three however resigned leaving Masit, who stood her ground that she was innocent of the allegations pressed against her.
Their suspension followed a recommendation by the National Assembly’s Justice and Legal Affairs Committee.
JLAC said the four petitions that sought the removal of the four met the threshold for them to be kicked out of office.
