Court Orders Late Jacob Juma to Pay 50million to two people for Grabbing their Land
The late contoversial businessman Jacob Juma has been ordered by a court to compensate two traders for stealing their 18 acres of land in Loresho, Nairobi.
According to Justice Loice Komingoi of the Environment and Land Court, Juma stole the prized site from Ashok Shah and Hitenkumar Raja in 2008 for KSh 500 million.
In her decision, Komingoi ordered the deceased to compensate the couple for being denied the right to own their property with KSh 50 million in restitution.
“Juma unlawfully interfered and grabbed the property from 2008, when the prime land in Loresho, Nairobi, was valued at Sh252 million. I am satisfied that the complainants have suffered damages for trespass into their property and are entitled to compensation of KSh 50 million,” Komingoi ruled.
Shah and Raja claimed in their filings that after claiming their property, Juma enclosed it with a perimeter wall to keep them out.
In addition, Komingoi ruled that there was enough evidence to demonstrate that Juma conspired with dishonest Lands registry employees to create a false title deed for the property in dispute.
After making a decision, the judge commanded Juma’s dependents to leave the property as soon as possible and return it to Shah and Raja.
Miriam Wairimu, the businessman’s widow, or someone else must pay the KSh 50 million in damages, as the court left it unclear who will do so.
