The union’s lawyer Henry Kurauka stated that the CS should face the law for seeking to terminate the contracts of the 23 senior managers against a court order.
“Sending the affected managers and other KEMSA employees on compulsory leave is tantamount to terminating their contracts which affects their terms and conditions of employment,” Kurauka was quoted as saying by The Standard on Tuesday.
According to the lawyer, CS Kagwe, KEMSA chairperson Mary Mwadime and acting CEO John Kabuchi went beyond their mandate and did not follow labor practices in sending the employees home last Thursday.
“The CS and the KEMSA board are in contempt of court when they are all aware of the court order which suspended any restructuring of the body. They cannot operate as if they are above the law and must be jailed for their actions,” Kurauka said.
He now wants Kagwe, Mwadime and Kabuchi thrown behind bars for six months for disrespecting the November 2021 court ruling which stopped restructuring the supplies agency following a petition by the doctors’ union.
KEMSA sent home the 23 senior managers and directors on Thursday in a move the agency said is aimed at reducing accrued leave days over two years.
